1. YOUR SIGNATURE:
The person signing and/or completing
the Booking Form accepts the conditions laid out below on behalf of himself/herself and
all other named persons on the Booking Form and represents that he or she is
authorised to accept these conditions on behalf of such
others. A booking is made in the name of the client(s) and is not transferable to another
person.
2. THE CONTRACT:
No contract shall exist between Keystone Journeys - and any of the Keystone Journeys service suppliers - and the Client until we have received the deposit and completed
Booking Form, and we have confirmed the booking to the Client or the
client’s Travel Agent. Keystone Journeys and any of the service suppliers reserve the right to decline any booking at its discretion.
3. PAYMENT:
The
balance of the tour cost must be paid no later than 5 weeks prior to
the departure date for all tours. Bookings made within 4 weeks
of departure must be paid in full.
4. AMENDMENTS & TRANSFERS:
Changes or amendments to your booking
will incur a £50 (or equivalent) charge per amendment. If the client wishes to transfer a booking to another trip or departure date,
this can be done at the discretion of the Company in notice and if subject to transfer fee of
£50 per person.
Discretion is used to determine any non-transferrable costs incurred on behalf
of the client by Keystone Journeys and the Company / Ground Agent used, i.e. Inca Trail Trek permits, which would be
payable in addition to the transfer fee. Notification must be received in
writing no less than ten weeks before original trip departure date. Transfer
requests received less than ten weeks before departure will be treated as a
cancellation and subject to the charges above.
5. CANCELLATION BY THE CLIENT:
Should a Client wish to
cancel a booking, the cancellation will take effect from the date Keystone Journeys
receives written notification. The applicable cancellation charges are as
follows:
South America Overland and Small Group; trips up to 70 days duration:
A cancellation received will incur the
following charges;
a) 70 days or more before departure - retention of deposit
b) 69 days - 46 days before departure - retention of deposit + 25% of total amount
c) 45 - 28 days before
departure - retention of deposit + 50% of total amount
d) Less than 27 days before departure - 100%
of total trip price / 0% of total price refundable
South America Overland and Small Group; trips 70 days or longer in duration:
A cancellation received will incur the
following charges;
a) 70 days or more before departure - forfeit of deposit
b) 69 days - 40 days before departure - 40% of total cost and forfeit of deposit
c) Within 39 days - 100% of total cost / 0% of total price refundable
South America - Premuim Overland Tours
A cancellation received will incur the
following charges;
a) 70 days or more before departure - retention of deposit
b) 69 days - 40 days before departure - retention of deposit + 50% of total amount
c) Less than 39 days before departure - 100%
of total trip price
Middle East and Egypt:
A cancellation received will incur the
following charges;
a) 70 days or more before departure - retention of deposit
b) 69 days - 46 days before departure - retention of deposit + 25% of total amount
c) 45 - 28 days before
departure - retention of deposit + 50% of total amount
d) Less than 27 days before departure - 100%
of total trip price
Africa:
Cancellation of the booking by the Client for any reason shall be in
writing signed by the Client and be received at the Company's trading address
whereupon, subject to provisions of the Company will
refund all monies paid by the Client other than the deposit. Cancellation by
email is not acceptable. The Client acknowledges that payment for the Tour
contributes to the overall provision of equipment, administration etc. specific
to that Tour and that the Company will incur a large part of its costs in set-up
before the actual date of departure. Therefore if the Client cancels the booking
less than 60 days before departure the Company shall be entitled to retain all
the monies paid by the Client.
Morocco:
Any cancellation of a booking must be received in writing and signed by the same
person on the original booking form. The cancellation charges are as
below:
8 weeks or more before departure lost deposit
Less than 8 weeks before departure - 50 %
Less than 4 weeks
before departure - 75 %
Less than 2 weeks before departure - 100%
Charges are levied on a Client and determined from the date the Company receives
the written cancellation from the Client. It is strongly advised that the Client
takes out suitable travel curtailment insurance immediately on booking. There
will be no refunds whatsoever for any section/s unused.
Antarctica: M/V Ushuaia
All requests for cancellations must be received in writing. Cancellations
received 90 days prior to departure are fully refunded less an administrative
fee of US$ 500 per person.
From 89 days up to and including the day of departure all deposits
and tariffs are forfeited. If cancellation occurs within the 89
day period and full payment has not yet been received, the full
penalty will still apply and unpaid monies are due immediately. For these and other reasons mentioned
below, you are strongly encouraged to obtain trip cancellation insurance. The Company reserves the right to cancel any voyage prior
to departure in which case payments will be refunded in full without
further obligation on our part.
Antarctica: Antarctic Dream
All requests for cancellations must be received in writing.
Cancellation received 90 days prior to departure will be fully refunded
less an administrative fee of US$500 per person. Within the 90 day
limit, all money is forfeited. If cancellation occurs within the 90 day
period and full payment has not yet been received, the full penalty
will still apply, and unpaid money is due immediately. For these and
other reasons mentioned below, you are strongly encouraged to obtain
trip cancellation insurance. Rates quoted are based on group
participation and no refunds will be made for any part of the program
in which you choose not to participate, including any helicopter flying
time (if applicable and which, at the discretion of the captain and
expedition leader, may or may not be utilized). It is understood that
refunds cannot be made to passengers who do not complete the tour for
any reason whatsoever.
6. CANCELLATION BY THE COMPANY/ CONVEYANCE OF THE CLIENT:
Keystone Journeys acting as an agent for Oasis Overland, African Trails, Nomadic Expeditions, Antarrply, Viva Expeditions, African Travel Co, Livingstone Deckers, The Safari Company, Overland NZ, Buffalo Tours, reserves the right to cancel a tour in the event the minimum number
of passengers is not met, or for any other reason determined by the
participating Company prior to departure. Clients must bear this in mind when
booking non refundable or restricted flights and insurance as the participating Company shall not be liable to compensate or refund any losses as a result
of a tour cancellation ie to refund any supplementary costs
paid out by the client due to these circumstances, i.e. flights, travel
insurance etc. The service suppliers accept no responsibility for matters arising out of political disputes,
border closures, epidemics, natural disasters, climate, force majeure, armed
robbery, terrorism et whilst on tour. Should it become necessary to abandon a trip due to such
an event, the participating Company will be entitled to retain such monies received necessary to
cover costs incurred. Refunds will therefore be issued on a pro-rata basis, the
portion of monies paid which are refunded reflecting the portion of the trip
completed. However, any unrecoverable costs already incurred in relation to the
uncompleted section of the trip will be deducted from this refund. The service suppliers reserve the right to deviate from the advertised trip route if in their
reasonable opinion such a deviation is necessary for the safety or wellbeing of
any or all of the members of the trip, or for the satisfactory progress of the
trip. In the event of it becoming necessary to fly over a country or countries,
all costs of the client's flights will be borne by the client. The service suppliers reserve
the right to make alterations to a trip without notice including alterations to
the itinerary. Should it not be possible for a trip to begin
from a scheduled departure city or town, due to political unrest, border
closures, natural disasters, U.K Government FCO advice, force majeure or any
other reason out of Keystone Journeys or the service suppliers control etc - they will make all reasonable efforts
to begin the trip from an alternative location. However, all additional costs
that the client may incur travelling to the alternative location to join the
trip, will be paid for by the client or their travel insurance company.
7: VEHICLE INSURANCE (South America)
The client acknowledges that in many countries we visit, the local vehicle
insurance includes either very limited passenger accident liability insurance or
none at all. Oasis has arranged passenger accident insurance & public
liability insurance through Campbell Irvine Ltd and claims against Oasis'
insurers must be held in a UK court of law.
8. UNUSED SERVICES:
There will be no refund for unused
services.
9. TRAVEL INSURANCE:
Before the Client commences a tour he or
she must obtain travel insurance with a reputable insurer to cover personal
injury, medical expenses, repatriation expenses, loss of luggage and the
expenses associated with cancellation or curtailment of a tour. The Client is
responsible for any loss or damage to baggage or personal possessions or any
consequential loss resulting there from. If a Client becomes ill, all hospital
expenses, doctors fees and repatriation costs are the responsibility of the
Client and the Company (Keystone Journeys or carriers) shall not be liable for any refund of the tour
cost. Clients should purchase travel insurance no later than at the time the balance
is due in order to cover themselves for their own cancellation or curtailment of
their travel plans. It is the client's responsibility to arrange suitable
adventure travel insurance with benefits that include cover for any hazardous
activities they intend to pursue, as well as personal accident, medical
expenses, repatriation and loss and damage to personal effects. The policy must
include minimum cover of £500,000 for emergency medical and repatriation
expenses. A copy of the client's travel insurance must be shown to the Tour
Leader at the start of the trip. In the event that a client does not have
suitable travel insurance they will not be permitted to join the trip. Keystone Journeys, Oasis, African Trails, Nomadic Expeditions, Antarrply, Viva Expeditions, African Travel Co, Livingstone Deckers, The Safari Company, Buffalo Tours, accepts no
responsibility regarding pre - existing medical conditions, disabilities or
impairments that may affect the enjoyment and / or successful running and
completion of a trip - including that of other members of the trip. Keystone Journeys and any of the service suppliers and/or
the client's insurance company should be notified of any such condition prior to
booking or taking out travel insurance.
10. TOUR PRICES:
Prices quoted on this website were correct
at the time of printing. However, as external factors may affect the exchange
rates, transportation taxes, operational and administrative costs, we reserve
the right to increase the price up to the day of departure. If after departure
additional expenses are incurred through delay, accident or disruption of
advertised schedules beyond the control of the Company (Keystone Journeys), such expense must be
borne by the Client. The trip price is guaranteed ONLY once full payment has been received.
11. FOOD & CAMPING COSTS / LOCAL TOUR PAYMENT/ TOUR COST:
Ths is part of the overall
tour price and once paid will not be refunded if the client cancels or leaves
the tour for any reason. The
Tour Cost and the Local Payment covers transport, accommodation, meals,
game parks, national reserves and excursions as specified in this
brochure and the repair and replacement of all camping equipment. The
Tour Leader has sole responsibility for the Local Payment on all trips.
This does not include the Local Payment amounts; the Local Payment is
subject to change up until departure, however the Local Payment will
not increase once the trip has departed. Any Local Payment monies
remaining at the trip end is non-refundable.
12: PASSPORTS AND VISAS
The client undertakes to be in possession of a valid passport with sufficient
blank pages for the entirety of the trip. It is the client's responsibility to
ensure that they only utilise the one passport for the entirety of the trip
(even if they are a dual national) and that they do not carry any criminal
convictions which may hinder the entry of themselves as well as the group to
areas visited whilst on the trip.
It is also the responsibility of the client
to ensure that they have not previously entered any countries, states,
territories that are deemed prohibited and which may also affect the
continuation of the trip. i.e. If entry/exit stamps into & out of Israel are
found in your passport you may be refused entry by certain countries.
12.a.
It is the client's responsibility to obtain all the necessary and up to date
information regarding visa and entry formalities - including the necessity to
obtain visa's prior to travel and allowing enough time to do so. Keystone Journeys and any service supplier cannot be
held responsible for clients who fail to obtain visas or who fail to research
what visas they need.
12. b. Keystone Journeys and service suppliers undertake to make all reasonable efforts
to assist a clients application for visas for the trip, through the information
published in the pre trip information. This service extends to applications made
in the UK and those made en-route in countries through which the trip passes,
but not in countries outside these areas. Keystone Journeys and/or service suppliers cannot guarantee visa prices or
availability of visas (even through prior knowledge or information as both these
factors are out of our control).
12.c. Should a clients passport be
lost/stolen/confiscated whilst on a trip, whether from a vehicle, a Company
representative, border official or direct by/from the client - it is understood
and agreed that Keystone Journeys and/or any booking Company cannot be held responsible for replacing the passport or
for costs incurred by the client for doing so.
13. CHANGES TO YOUR ARRANGEMENTS:
All tours and
associated arrangements are subject to alteration without notice if necessary
because of factors beyond the control of Keystone Journeys, including, but not limited
to exchange rate changes, political disputes, climatic
variations, airline departure time changes, although where possible, details of
such alterations will be sent to the last known address of the Client as soon as
the Company is aware of such alterations. The Company (Keystone Journeys) reserves the right to
alter itineraries if it is in the interest of the Client to do
so.
14. RISKS:
Whilst Keystone Journeys and all of the service suppliers will take all reasonable precautions to provide for
the Client’s safety and comfort, the Client accepts that these tours
carry inherent risks and any Client wishing to participate in such
activities must be able to assume this risk. The Client must be in good
health to join these tours. Keystone Journeys, the service suppliers or its
agent shall not be liable for personal injury, damage or loss - including
consequential loss - to any Client however caused. This includes
personal injury caused or contributed to by the negligence, breach of
contract or duty to the Company’s servants, agents or any independent
contractor whether English or foreign law.The client must acknowlegde
that participation on any of the tours on our website may involve a
certain degree of personal risk. The client acknowledges that his/her decision
to travel to their chosen destination is willing to assume the personal risk
upon such travel. The client accepts that owing to the nature of countries visited, all trips
involve an element of personal risk and are of a potentially hazardous and
unpredictable nature. In many countries visited, the basic infrastructure such
as roads, is very poor and therefore less safe than that familiar to people from
western/other countries. In particular - some of the factors beyond the control
of the service suppliers include: lack of road markings & or warning signs, unmarked speed
bumps, seasonal flooding of roads and bridges, local vehicles which can be
poorly maintained, driven & hazardous to other road users etc. The client
accepts that in some areas or situations there will be little or no choice but
to drive 'off road' - which involves personal risk due to the rough terrain that
the expedition vehicle may need to negotiate. The client accepts that
in many countries through which we pass the local emergency services and
facilities are of a very limited nature compared to western countries. Hospitals
outside major cities often have no accident and emergency facilities.
15. COMPLIANCE WITH LOCAL LAWS:
The Client will comply
strictly with all laws, customs and foreign exchange restrictions of any country
visited. The Company shall not be responsible or liable for any Client who
contravenes any law or regulation of any country
visited. The client undertakes to comply with the laws and regulations of all the
countries visited during the trip, including those relating to health,
immigration, foreign money exchange and other matters.
16. UNSUITABILITY OF CLIENT / CODE OF CONDUCT
If the Tour Leader considers the actions or conduct of any client is likely to
jeopardise the safety, wellbeing and/or enjoyment of any or all members of the
trip, as well as the satisfactory progress of the trip - then they shall be
entitled to order the client to leave the trip immediately. Any trip and Local
Payment contributions remaining will be forfeited by the client. All liability
and responsibility that the company may bear to the client will immediately
cease, including any provision for alternative transport.
In the event of
any person leaving the expedition of their own accord, that person will be
liable for their own maintenance and expenses and have no claim against the service supplier
whatsoever. Any trip monies paid will be forfeited by the client.
17: THE TOUR LEADER
The decision of the Tour Leader will be final on all matters relating to the
satisfactory progress, organisation and wellbeing of the trip. Clients must
comply with all reasonable requests of the Tour Leader. If it is the opinion of the service supplier's Tour Leader or Directors, that the health or conduct of a client, at any
time before or after departure, appears likely to endanger the
safe/comfortable/happy progress of a trip, the client may be excluded from all
or part of the trip without refund or recompense of any trip costs or Local
Payment contributions remaining. In the case of an emergency or ill health of a
client the service supplier may make such medical arrangements as it sees fit and thereafter
reclaim the costs incurred from the client. If a client commits an illegal act
the client will be excluded from the trip and the service supplier shall cease to have
responsibility to/for them. The client will be liable for their own maintenance
and expenses and have no claim against Oasis whatsoever. Any trip and Local
Payment contributions remaining will be forfeited by the client.
18. COMPLAINTS:
If
the Client has any complaint about the tour booked he or she should
first bring this to the attention of the Tour Leader. If at the end of
the tour, the client feels that his or her complaint has not been
properly dealt with, the Client must notify the Company (Keystone Journeys) in
writing within 14 days of completion of the tour so they can be effectively dealt with. In the event of a claim for compensation, the client agrees that any such claim
must be received at its office within 30 days of the completion date
of the trip. No compenstion will
be paid to any client that has completed their tour with the company.
19. FOOD ALLERGIES:
The client must notify the Company upon booking of any food allergies you have at the time of booking. Further it is the Clients
repsonsibility to ensure the food that is prepared is suitable for
you.
20. OPTIONAL EXTRAS:
These do not form part of the tour
or contract. The client accepts that any assistance given by the Tour Leader or
representive in arranging such activities does not render the Company (Keystone Journeys) liable for
optional extras. These optional extras are not included in your tour
price. Keystone Journeys, is not responsible for the Client when he or she embarks on any
optional activity. Keystone Journeys and the service suppliers do not necessarily endorse any
optional activity available on the tour. Clients accept that the prices quoted for accommodation, optional activities,
local costs and spending money are approximate, as prices can and do change
without prior notification after publication of this brochure. Clients also accept that they undertake any optional activity at their
own risk and their participation is their own decision, and does not form any
part of their contract with Keystone Journeys or the service supplier. Keystone Journeys and the service supplier do not take responsibility
for cancellations, unreliability of services or safety of local operators,
activity providers, agents or contractors in regards to any optional activity.
Furthermore, as participation in any such activities does not form part of any
contract with Keystone Journeys and the service supplier. We cannot be held liable for any loss, injury or
consequential loss which may arise directly or indirectly as a result.
21. CREDIT CARD PAYMENTS:
If
a credit or charge card is used to pay either deposit or balance
payment then a 2.5% surcharge will be levied on the amount (This will
be a 4% charge if booked with a US or Canadian card). This amount is
subject to change without notice depending on country of payment..
22. WEBSITE:
Information given in website, leaflets and advertising material is given in good faith by Keystone Journeys at the
time of print, but unless specially stated, shall not form any part of the
contract. The Company reserves the right to use photos or video footage and
comments taken during your tour for any advertising or brochure production
without obtaining further consent.
